Welcome to Anaphora. These Website Terms & Conditions (“Terms”) govern your use of the website operated by ANAPHORA, LLC (“Anaphora,” “we,” “us,” or “our”).

1. About Anaphora

Anaphora, LLC is a Vermont-based wedding floral and stationery design studio providing custom floral design, wedding stationery, paper goods, and related design services.

Information provided on this website is for general informational and promotional purposes. Website content does not constitute a binding offer to provide services.

Actual services, pricing, availability, payment requirements, cancellation policies, and other terms are established through a separate written proposal, invoice, contract, or client agreement.

In the event of a conflict between these Website Terms & Conditions and a signed client agreement, the signed client agreement will control with respect to that client’s services.

2. Use of This Website

You agree to use this website only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the website.

You may not:

Use the website for any unlawful or fraudulent purpose;
Attempt to gain unauthorized access to the website or its systems;
Copy, reproduce, modify, distribute, or exploit website content without written permission;
Use photographs, designs, text, graphics, branding, or other materials from this website for commercial purposes without permission;

3. Services, Pricing & Availability

The services, pricing, packages, examples, photographs, descriptions, and other information displayed on this website are subject to change without notice.

Website photographs and portfolio examples are provided to illustrate our design work and aesthetic. They do not guarantee that identical flowers, materials, colors, products, designs, or services will be available for your event.

All custom services are subject to availability and are confirmed only after Anaphora and the client enter into the appropriate written agreement and any required retainer or payment has been received.

4. Floral Design & Substitutions

Flowers are natural, seasonal products and are subject to availability, weather, growing conditions, transportation, market conditions, and other circumstances outside our control.

For floral services, Anaphora reserves the right to make reasonable substitutions when a requested flower, color, variety, material, or product is unavailable or unsuitable.

We will use our professional judgment to maintain the intended overall aesthetic, color palette, scale, style, and value of the agreed design.

Specific flower varieties shown in inspiration images or discussed during the design process are not guaranteed unless expressly stated in a written client agreement.

5. Custom Stationery & Proof Approval

Custom stationery is created specifically for each client.

Before production, clients are responsible for carefully reviewing and approving all proofs, including but not limited to:

Names and spelling;
Dates and times;
Addresses;
Guest information;
Wording;
Grammar;
Quantities;
Colors;
Paper selections;
Envelope addressing;
Other printed or production details.

Once a proof has been approved for production, Anaphora is not responsible for errors that were present in the approved proof.

Changes requested after approval may result in additional design, production, printing, shipping, or other fees.

6. Payments, Retainers & Refunds

Specific payment schedules, retainers, deposits, balances, cancellation provisions, and postponement terms are established in each client’s written agreement or invoice.

Unless otherwise expressly stated in a signed written agreement:

Retainers, deposits, payments for custom design work, custom-ordered materials, printed goods, and completed services are non-refundable.

Because Anaphora provides customized design services and often commits time, materials, labor, production capacity, and vendor orders specifically for a client, payments may be applied to work or expenses that cannot reasonably be recovered or resold.

Once custom work, printing, production, purchasing, or other services have begun, amounts paid may not be refundable.

Nothing in these Terms is intended to waive or limit any refund or other right that cannot lawfully be waived under applicable law.

7. Cancellations & Postponements

Cancellation, postponement, rescheduling, and date-change policies are governed by the client’s individual written agreement.

A cancellation or postponement does not automatically entitle a client to a refund.

Because wedding dates require Anaphora to reserve creative time, production capacity, labor, materials, and event-specific resources, cancellation or postponement may result in amounts remaining due as specified in the applicable client agreement.

8. Creative Direction

Clients hire Anaphora for its creative expertise and design judgment.

By engaging Anaphora, clients acknowledge that final designs may vary from inspiration images, preliminary concepts, mood boards, sketches, or examples.

Inspiration images are used to communicate aesthetic direction and are not guarantees of an identical final product.

Unless otherwise specified in a written agreement, Anaphora retains reasonable creative discretion regarding the selection, placement, scale, proportion, color balance, flower varieties, materials, and other design elements necessary to execute the agreed creative direction.

9. Intellectual Property

All original content on this website, including but not limited to:

Photography;
Floral designs;
Stationery designs;
Graphics;
Logos;
Branding;
Written content;
Layouts;
Illustrations;
Templates;
Downloadable resources;
Other original materials;

is owned by or licensed to Anaphora, LLC and is protected by applicable intellectual-property laws.

You may view and use website content for your own personal, non-commercial purposes only.

You may not reproduce, copy, modify, publish, distribute, sell, license, create derivative works from, or commercially exploit Anaphora’s website content or designs without prior written permission.

Custom Designs

Unless otherwise provided in a written agreement, Anaphora retains intellectual-property rights in original creative concepts, artwork, illustrations, layouts, design files, templates, and other underlying creative work created in connection with a project.

Payment for a finished product does not transfer ownership of the underlying creative work unless expressly stated in writing.

10. Photography & Promotional Use

Unless otherwise agreed in writing, Anaphora may photograph completed floral installations, stationery, paper goods, and other design work created for clients and may use those photographs for portfolio, editorial, website, social media, advertising, educational, and other promotional purposes.

Anaphora will make reasonable efforts not to publicly display private personal information, including guest addresses, telephone numbers, email addresses, or other sensitive information visible on stationery.

Clients who have specific privacy concerns regarding identifiable people, venues, or event details should communicate those concerns to Anaphora in writing.

Any separate photography or image-use provisions contained in a signed client agreement will control.

11. Website Content & Accuracy

We make reasonable efforts to keep website information accurate and current. However, we do not guarantee that all website content will always be complete, current, accurate, or error-free.

Pricing, availability, service offerings, portfolio examples, vendor information, and other website content may change at any time.

12. Third-Party Websites & Services

This website may contain links to third-party websites, social media platforms, payment processors, email marketing services, analytics services, or other third-party services.

Anaphora does not control and is not responsible for the content, security, availability, privacy practices, or policies of third-party websites or services.

Anaphora will not be responsible for delay or failure to perform caused by circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, fire, flood, transportation disruption, supplier failure, governmental action, labor disruption, illness, venue closure, acts of God, or other unforeseen circumstances.

Specific remedies and responsibilities for a wedding or event affected by such circumstances are governed by the applicable client agreement.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Anaphora, LLC and its owners, employees, contractors, and representatives from claims, losses, liabilities, damages, costs, and expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

18. Governing Law

These Terms are governed by the laws of the State of Vermont, without regard to conflict-of-law principles.

Any dispute relating specifically to use of this website shall be brought in a court of competent jurisdiction in Vermont unless otherwise required by applicable law.

Any dispute arising from a specific client engagement will be governed by the dispute-resolution provisions contained in the applicable client agreement.

19. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

20. Changes to These Terms

Anaphora reserves the right to update or modify these Terms at any time.

The “Last Updated” date at the beginning of these Terms will identify when the Terms were most recently revised.

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by law.
